Right of publishers of press publications

A publisher of press publications is a  publisher of journals, media publisher or media service provider (for example, news publisher or press agency), when publishing press publications.

Subject matter of protection of this right is a press publication (such as newspaper or magazine of general or specialised topics) or a collection comprising mostly of written copyright works of journalistic nature, which can contain other types of works as well or subject matters of related rights, including photographs and video content and which represents an individual element within a periodical or a regularly updated publication, published under one title, aiming to inform the public about current news or other topics and published on any media under initiative, editorial responsibility and control of a newspaper or publication editor or a  publisher of journals or a media publisher or a media service provider.

Pursuant to the Copyright and Related Rights Act, exclusive rights of publishers of press publications, except in relation to the use by an information society service provider relate to:

  1. reproduction;
  2. distribution, including renting;
  3. communication to the public in any manner, including making available to the public;
  4. adaptation.

A publisher of press publications is also entitled to an equitable remuneration for:

  • reproduction for private use of his press publications;
  • lending of his press publications by mediation of public libraries.

These rights of a publisher of press publications run for ten years as from the first lawfully published press publication.

Exclusive rights of publishers of press publications in relation to the use by information society service providers relate to:

  1. reproduction;
  2. communication to the public in any manner, including making available to the public.
     

These rights do not apply in relation to:

  1. individual users who use press publications and parts thereof for private and non-commercial purposes;
  2. actions of hyperlinking;
  3. use of individual works or very short excerpts, with no more than a few words and without any photos or video contents.

These rights of a publisher of press publications run for two years as from the first lawfully published press publication.
