Patent Application via Regional Protection System
The procedure for granting a European patent, carried out by the European Patent Office (EPO), provides for patent protection in the member states of the European Patent Organization and the states that recognise a European patent in its territory. An application can be filed electronically via the service of EPO online filing. The same service enables filing an application for a patent via international protection system (Euro-PCT and PCT applications).
Patent Application via International Protection System
Applicants from Croatia can file an application for patent protection via the international application system based on the Patent Cooperation Treaty (PCT) in more than 155 member states of that system either through the Office or directly with the competent International Bureau of the World Intellectual Property Organization (World Intellectual Property Organization - WIPO).
It should be noted that this system (the PCT system) does not allow for a single patent protection procedure in the member states of the system, but rather for a single application for patent protection instead of individual national or regional patent applications. After the application has been filed via the PCT system and the international phase of the procedure has been completed, the decision on the (non)grant of the patent is made by each of the national or regional offices in the national or regional phase of the procedure, which is carried out in accordance with the legal regulations of the state or regional organisation concerned. The application can be filed via the WIPO online platform e-PCT.
